Failed a DOT Drug Test? How Commercial Drivers Start the SAP Process

A positive or refused DOT test starts a federal return-to-duty process. Here’s how company CDL drivers start the SAP process, step by step, and what to ask your employer.

Share: LinkedIn Email

If you’re a commercial driver and you fail or refuse a DOT drug or alcohol test, you’re removed from safety-sensitive duty right away, and the only way back is the federal return-to-duty process run by a qualified Substance Abuse Professional (SAP). The process has set steps: an initial SAP evaluation, the education or treatment the SAP recommends, a follow-up evaluation, a return-to-duty test, and follow-up testing. Starting quickly is the best way to shorten the time you’re off the road.

Article summary

  • A failed or refused DOT test removes you from safety-sensitive duty right away.
  • Designate a qualified SAP in the FMCSA Clearinghouse to start the return-to-duty process.
  • Expect an initial evaluation, education or treatment, a follow-up evaluation, a return-to-duty test and follow-up testing.
  • Don’t assume your mental health benefit pays for the SAP. Ask your employer and confirm.

What happens right after a violation

Your employer must remove you from driving and other safety-sensitive work. Under DOT rules, the employer also has to give you a list of qualified SAPs (49 CFR Part 40). Since November 18, 2024, a “prohibited” status in the FMCSA Drug and Alcohol Clearinghouse also leads your state licensing agency to remove the commercial privileges from your license until you complete return-to-duty (FMCSA). Read more in CDL downgrade after a failed drug test.

The SAP process, step by step

  1. Choose a qualified SAP and designate them in the Clearinghouse. Log in to the FMCSA Clearinghouse and select your SAP. Here’s how to designate your SAP.
  2. Complete the initial SAP evaluation. The SAP reviews your history and the violation and recommends education, treatment or both. See what happens at a SAP evaluation.
  3. Finish the recommended education or treatment. Keep attendance records and completion letters.
  4. Complete the follow-up evaluation. The SAP confirms whether you’ve complied and reports to your employer.
  5. Take a directly observed return-to-duty test. Your employer decides whether to return you to duty, and the test must be negative.
  6. Complete follow-up testing. The SAP sets a plan of at least six unannounced, directly observed tests in your first 12 months back, and testing can continue for up to five years (49 CFR 40.307). Learn more about follow-up testing.

Company drivers and your employer

If you drive for a large fleet or private fleet, your employer’s Designated Employer Representative (DER) handles the employer side. Completing return-to-duty restores your eligibility to drive, but each employer decides whether to bring you back. Ask your DER or HR:

  • Who receives the SAP’s reports for the company
  • Whether the company will consider you for return to duty
  • Whether any part of the SAP fee or treatment is covered, and by whom

Don’t assume your mental health benefit pays for a SAP evaluation. Even employers that offer Spring Health, Lyra or BHS/Revive for therapy handle SAP payment differently, and payment has to be confirmed for your case.

What education or treatment can include

A SAP evaluation is not therapy. It’s a federally required assessment with reports to your employer. The education or treatment that follows depends on your situation and may include:

  • Substance use education focused on safety and DOT rules
  • Counseling using motivational interviewing, an evidence-based approach for building commitment to change (SAMHSA TIP 35)
  • Cognitive behavioral approaches to manage triggers, stress and relapse risk
  • Outpatient or more intensive treatment when the evaluation shows a higher level of need

Some drivers also want confidential therapy for the stress, shame or family strain that comes with a violation. That’s a separate, voluntary service, and it can run alongside the SAP process.

Frequently asked questions

How soon can I start the SAP process?

Right away. You don’t need to wait for your employer, though you’ll need to designate your SAP in the Clearinghouse. Starting early shortens the time you’re off duty.

Do I need an employer to complete the SAP process?

No. You can complete the SAP steps without a current employer, but you’ll need a DOT employer to conduct the return-to-duty test. See the SAP process without an employer.

Does my company’s Spring Health benefit pay for a SAP evaluation?

Don’t assume it does. Spring Health, Lyra and BHS/Revive are mental health and EAP programs, and SAP payment arrangements vary by employer. Ask your DER or HR, and we’ll discuss payment options at intake.

Is a SAP evaluation the same as counseling?

No. A SAP evaluation follows federal rules and includes reports to your employer. Voluntary therapy is confidential and separate.

Can I do the SAP evaluation online?

Our evaluations are by secure live video for drivers physically located in New York, New Jersey, Georgia or Massachusetts.

What if I refused the test?

A refusal is treated as a violation, with the same return-to-duty steps. See why a refused DOT test counts as a violation.

Need a DOT SAP evaluation?

DOT SAP evaluations are separate from EAP therapy. Start our SAP intake and we’ll explain the process and payment options. Employer or EAP payment is not guaranteed.
