Follow-Up Testing After Return to Duty: What to Expect

After return to duty, DOT requires at least six unannounced follow-up tests in the first year, for up to five years. Here is how the plan works.

Going back to work isn’t the end of the process. Every employee who returns to safety-sensitive duty after a violation has a follow-up testing plan set by their SAP.

The minimum rules

  • At least six unannounced tests in the first 12 months back on duty
  • The plan can last up to five years
  • Your SAP decides the number and length, and can end the plan after the first year
  • Follow-up drug tests are directly observed
  • FRA employees: at least six drug tests and six alcohol tests in the first year

Who runs the plan

Your SAP sets the plan and sends it to your employer. Your employer schedules the tests. You won’t get a copy of the plan, because the tests must stay unannounced.

If you change jobs

The plan goes with you. A new DOT-regulated employer must continue it until it’s complete, which is why employers ask about prior violations before hiring.

Follow-up vs. random testing

Follow-up tests are in addition to your employer’s random testing program. You can be selected for both.

What if a follow-up test is positive?

A positive or refused follow-up test is a new violation. You’re removed from duty again and start a new SAP process.

Frequently asked questions

Can I ask how many tests I have left?

The plan is kept from employees so the tests stay unannounced. Your employer tracks it.

Who pays for follow-up tests?

DOT doesn’t assign payment. It depends on your employer’s policy or agreements.

Can follow-up testing include alcohol?

Yes. Your SAP may require drug tests, alcohol tests or both.
