Losing your job after a DOT violation doesn’t mean you have to wait to get started. You can complete the SAP process on your own. If you hold a CDL, that includes your return-to-duty test, so you can be cleared in the FMCSA Clearinghouse before you apply for your next safety-sensitive job.
What you can do without an employer
- Choose a qualified SAP and complete your initial evaluation
- Receive copies of your SAP reports (the follow-up testing plan is left out)
- Complete the education or treatment your SAP recommends
- Complete your follow-up evaluation with the same SAP
- Schedule your return-to-duty test through a consortium/third-party administrator (C/TPA)
- Get cleared in the Clearinghouse once your negative result is reported, changing your status to “not prohibited”
What goes to your next employer
Your follow-up testing plan. Your SAP sets the number and frequency of unannounced follow-up tests, and that schedule goes only to the DOT-regulated employer who hires you for a safety-sensitive role. You won’t receive it. Your new employer carries out the plan from your first day back.
CDL drivers and owner-operators
If you hold a CDL, your violation stays in the FMCSA Clearinghouse with a prohibited status until the return-to-duty test is reported. You should still designate your SAP in the Clearinghouse right away so your evaluation and compliance dates can be recorded. If you don’t have an employer, register in the Clearinghouse as an owner-operator (choose “Register as an Employer and Driver”) and designate a C/TPA. The C/TPA directs your return-to-duty test and reports the negative result. You don’t need a U.S. DOT number to do this. See our FMCSA return-to-duty steps.
Why starting now helps
Employers hiring for safety-sensitive roles will check your history. Arriving with your evaluation and treatment already finished means you can arrive already cleared in the Clearinghouse, with only follow-up testing left for your new employer to manage. That can shorten your time out of work by weeks or months.

Will my SAP report go to my old employer?
No, not if you no longer work there. Your SAP can give you copies of your reports with the follow-up testing plan removed. The full report, including the testing schedule, goes to your next DOT-regulated employer.
How much does it cost if I’m paying myself?
Our $500 fee covers all of our professional SAP services, including both evaluations and reports. Education, treatment and testing are separate. Payment arrangements may be available.
Can I see a different SAP when I get a new job?
No. You must finish with the SAP who evaluated you. DOT rules don’t allow switching SAPs to get a different recommendation.
