Can I Complete the DOT SAP Process if I Am Unemployed?

How self-referred and unemployed safety-sensitive workers can begin the DOT SAP process.

You do not have to wait for a new employer to begin addressing a DOT violation. Self-referred and unemployed safety-sensitive professionals may start the SAP process.

What you can complete without an employer

You can select a qualified SAP, complete the initial evaluation, receive the recommendation, complete education or treatment and attend the follow-up evaluation.

Where an employer becomes necessary

A current or prospective DOT-regulated employer is needed to arrange the return-to-duty test, make the decision about safety-sensitive duties and implement the follow-up testing plan.

What to tell a prospective employer

Be prepared to explain that you have completed—or are completing—the SAP process and to provide the information needed for the employer or C/TPA to obtain the proper report through the required system or communication route.

Why starting early may help

Beginning before a job offer may reduce avoidable delay later, although no SAP can promise employment, a specific timeline or an employer’s decision.

Frequently asked questions

Can I complete the SAP evaluation while unemployed?

Yes. You can complete the evaluation, recommendation and follow-up evaluation without a current employer.

Who orders the return-to-duty test?

Usually a current or prospective DOT-regulated employer. FMCSA provides a limited C/TPA route for CDL drivers without an employer; the SAP does not perform the test.

Does completing the SAP process guarantee a job?

No. The SAP documents compliance and testing eligibility. Employment and return-to-duty decisions belong to the employer.
