The DOT Return-to-Duty Process, Step by Step

A clear explanation of evaluation, recommendations, follow-up, employer-controlled testing and the follow-up testing plan.

The DOT return-to-duty process is a sequence—not one appointment, one course or an instant clearance. Understanding who controls each step can help you avoid unnecessary delays and false promises.

1. Stop safety-sensitive work and select a qualified SAP.

After a DOT drug or alcohol violation, the worker must be removed from DOT safety-sensitive functions. The first professional step is an evaluation by a qualified Substance Abuse Professional.

2. Complete the initial SAP evaluation.

The SAP conducts an individualized clinical assessment and must recommend education, treatment or both. The recommendation is based on the evaluation and is not automatically the same for every client.

3. Complete the recommendation.

The worker completes the required education or treatment with the appropriate provider and makes sure the SAP receives documentation needed to evaluate compliance.

4. Attend the follow-up SAP evaluation.

The SAP reviews the documentation and conducts a follow-up clinical evaluation. If the worker demonstrates successful compliance, the SAP documents eligibility for return-to-duty testing and provides the required follow-up testing plan.

5. Complete the employer-directed return-to-duty test.

If the employer decides it wants to permit a return to safety-sensitive functions, the employer ensures the return-to-duty test is completed. A drug test must be negative; an alcohol test must be below 0.02. The SAP does not perform or schedule this test.

6. Follow the testing plan after returning to duty.

After a return to safety-sensitive work, the employer implements the SAP’s unannounced follow-up testing plan. The plan may continue for up to 60 months, depending on the SAP’s determination.

How long does the process take?

Initial SAP scheduling may be available within 24 hours after intake and payment, but no qualified provider can honestly promise that the entire process will finish in 24 hours. Timing depends on the recommendation, completion, documentation, follow-up evaluation and employer-controlled test.

Is the return-to-duty test the fourth major stage?

It follows the initial evaluation, completion of the recommendation and the follow-up evaluation. The employer controls the test and the safety-sensitive work decision.

Does the SAP administer the drug or alcohol test?

No. The SAP determines compliance and testing eligibility. The employer or another authorized party arranges the test through the proper testing program.

Can the entire process be finished within 24 hours?

No guaranteed timeline applies to the full process. Only the initial appointment may often be available within 24 hours after intake and payment.
