Recreational or medical marijuana may be legal where you live, including New York, New Jersey and Massachusetts. For DOT safety-sensitive workers, it doesn’t matter. DOT testing follows federal law.
Why state law doesn’t apply
DOT drug testing rules are federal. Marijuana remains a prohibited substance under DOT regulations, so a verified positive THC result is a DOT violation no matter what your state allows.
Medical marijuana cards
A Medical Review Officer can’t accept a state medical marijuana recommendation as a legitimate medical explanation for a positive DOT test. The result is still reported as positive.
What about CBD?
DOT has warned that CBD products aren’t closely regulated and may contain more THC than their labels say. Using CBD is not accepted as a reason to excuse a positive result. If you’re in a safety-sensitive job, the safest choice is to avoid these products.
What happens after a positive THC test
- You’re removed from safety-sensitive duty
- You complete a SAP evaluation and the recommended education or treatment
- You complete a follow-up evaluation with the same SAP
- You pass a directly observed return-to-duty test
- You complete follow-up testing for at least a year
CDL drivers also face a prohibited Clearinghouse status and possible CDL downgrade. Learn about Clearinghouse II.
Frequently asked questions
I used marijuana days ago, off duty. Does that matter?
DOT testing doesn’t distinguish on-duty from off-duty use. A verified positive is a violation.
Will the SAP judge me for legal use?
No. The SAP’s job is a clinical assessment, not a moral judgment. The recommendation is based on your situation.
Can I keep using it after I return?
Any future positive during follow-up or random testing would be a new violation.
